QUEST ADVENTURE ACTIVITIES LIMITED BOOKING AGREEMENT WITH FULL BOOKING TERMS AND CONDITIONS

Booking Agreement

  1. Main Centre Address

  2. Fees
    To book your activity with Quest Adventure Activities telephone the office to check the current cost and availability. At this point a provisional booking will be held for 7 days where agreed.

    Provisional bookings do not hold firm until the required deposits have been received.

    All places must be reserved by Q.A.A. Ltd receiving a deposit for all activities. Payment of the deposit includes full acceptance and understanding of all booking term and events terms, regulations and conditions.

    The balance of the full payment is payable 10 days prior to commencement of the activity. In the event that the balance is not paid by due date Q.A.A. Ltd will have the discretion to treat the booking as cancelled by the client and re-sell the activity place.

    The whole activity fee is required to reserve a place for any booking made within 2 weeks of the commencement of the activity.

    On payment of deposit the booking will be confirmed, and all terms and conditions of the booking fully accepted [Please refer to booking terms and conditions]. Full booking terms and conditions agreement are attached to the original enquiry correspondence or can be sent on request.

    When booked on or merged with in a mixed group it must be accepted that participants will have a varying level of ability and competency.

    Groups of less than 12 may merged together as one group and one activity as booked by the majority of the participants with maximum of 12 participants and charged the group rate appropriate for the activity or subsequently the group size rate offered for the activity, whichever may be the lowest amount quoted for the group booking and the activity requested.

  3. Cancellation By Client
    All cancellations must be in writing.

    In the event of cancellations for reasons other than illness or injury (medical certificate required) the

    following charges apply: -

    More that 6 weeks prior to activity commencement loss of deposit only.

    Between 6 to 4 weeks prior to activity commencement 50% of activity fee.

    Between 4 to 2 weeks prior to activity commencement 75% of activity fee.

    Less than 2 weeks prior to activity commencement full payment.

    We recommend you take out personal insurance to cover all eventualities and all our activities are fully insured under a comprehensive commercial Insurance policy.

  4. Cancellation By Quest Adventure Activity Ltd
    Due to the environmental, logistical, planning, administration nature of all our activities, we may evaluate if conditions for the event are suitable/unsuitable 24 hours prior or on the actual day of the activity. Due to these factors entailing implemented costs we are unable to offer a full refund if conditions are evaluated to be unsuitable 24 hours prior or on the actual day of the activity

    Due to these factors in the subsequent case of cancellation due to adverse uncontrollable conditions an alternative event will be offered with suitable qualifying conditions. If the alternative activity is rejected, then an activity voucher for the full cost of the activity to the sum of the payment received per person will be issued to the person or persons due to attend the event and activity.

    The voucher will be issued on receipt of full details of the participant are received within 14 days of the cancellation. The voucher will be valid for 12 months from issue and will be transferable to another person where advised and accepted by all parties.

    The voucher booking will be issued under the same terms and conditions as the original booking and within the same booking structure, voucher bookings will be required to book in as group structures or as individuals attending as part of a group structure.

    Quest Adventure Activities limited agree to notify of cancellation as soon as the conditions have been assessed either 24 hours prior or on the actual day of the event

  5. Safety
    All activity members must comply with safety regulations and instructions of Quest Adventure Activities Limited as stated in the confirmation email for the particular event.

    Should an instructor find that an activity member/ s is being disruptive or jeopardizing the safety of

    others then that person / s will be asked to leave the activity.

    Due to the nature of our activities, we strongly recommend that you take out an insurance policy before you attend an activity.

    Due to the implications of evacuation, rescue and medical assistance in the outdoor environment, any person or persons arriving 20 minute later than booked and agreed for an event or activity will result in cancellation of their activity or group activity without refund to any persons involved.

    On payment of deposit the booking will be confirmed, and all terms and conditions of the booking fully accepted [Please refer to booking terms and conditions]. Full booking terms and conditions agreement are attached to the original enquiry correspondence or can be sent on request.

    Groups or families with children 10 years of age or younger must contact the centre first to discuss the options and possibly look to book as a private group in order to give extra consideration for the younger members of the group. Group or family members under the age of 12 may not be able to take part in the Coasteering or Canyoning events due to the challenges involved in the activities and difficulty with the evacuation from the sites used for the activities. Parents or organisers must contact the centre before booking to discuss the options available. Group or family members under the age of 16 may not be able to take part in the Ultimate Canyoning Exploration event due to the challenges involved in the activities and difficulty with the evacuation from the sites used for the activities. Parents or organisers must contact the centre before booking to discuss the options available

    The gorge is a SSSI protected site and part of the National Trust, due to its natural beauty and scientific importance only licensed companies are allowed to use the site under the licensing and regulations of the National Trust and the Forestry Commission, therefore the following rules and regulations are imposed on the site and all users:

    - Many of our Instructional safe are also environmentalists, researchers, scientific researchers, project co-ordinators, ecologists, ornithologists and may conduct observations, research, surveys, photographic imagery but the priority will always be on the group safety and control through out the event.

    -  Instructional Briefing and Instructions to be Agreed to and Adhered to through the whole event for the safety of the individual, the group and the instructors.

    -  No leaving litter at the site or urination or defecating at the site

    - Confirmation of the booking also confirms acceptance of the booking form details as attached to the email.

    - The activity will include various challenging situations including swift water, wild swimming, swift water rapids, cold water environments, small-medium-high level jumps into deep water plunge pools, traversing, scrambling, climbing, bouldering, chest level diving etc each situation will be dependent group ability, water levels, temperature, terrain, discipline, group control, other groups, prior ability, etc certain parts of the activity may after assessment be deemed to severe or unsafe for the group or group member to attempt due the considered factors of safety, group ability and environment.

    -  Times of the activity are allocated by the National Trust and must be adhered to, members or Groups attending 20 minutes later than booking time arranged may result in cancellation of the activity with no refund of costs returned to individual or group members.

    - The evacuation off the gorge and the canyoning sites can be logistically very difficult with Mountain Rescue and Helicopter Air lift available to extract from site, the alternative is to exit the site manually to expedite the process due to other relevant factors and situations such as the casualty welfare, environment, group care etc, in all eventualities the evacuation will be arduous and uncomfortable for all parties, all members of the group must be aware of the evacuation procedures and agree to the eventuality of the process if an incident were to occur in order to continue with the event. Emergency services in the area may not prioritise an incident as high priority and take a prolonged amount of time to attend therefore personal or private transportation to medical facilities may be required to expedite the continued care of the patient. The injured person may also give authority to be assisted walked off the site in order to expedite there care and get to emergency care quicker than waiting for the emergency services, this is a decision the person will have to agree to with knowledge of the discomfort and complications to the injury this may cause. In the case of a minor then the parent will also have to consent to this action.

    - Photographs of the activity are to be requested prior to the event and will be taken if the conditions are suitable and safe to do so, the quality of the pictures will be determined by the environment of the event, client safety will prioritize the taking of pictures. Photographs taken may be used by Q.A.A.Ltd for marketing and promotions unless otherwise advised.

    -  No abusive, aggressive or inconsiderate behavior to members of the staff, public or group at any time. Any member of the party considered to be under the influence of Alcohol or drugs will be excluded from the event without reimbursement of costs.

    -  If travelling by car please park in designated areas and use as few vehicles as possible.

    -  If conditions are unsuitable an alternative event will be arranged for the same day.

    -  No nudity all members to change in the changing area provided, large toweling or using changing robes act of nudity will be classed as cases of incident exposure.

    -  Consideration and respect for all local residents and their families and visiting members

    -  Consideration and respect for all other users of the site

    -  Commitment by all members to act in accordance with the safety of themselves and others

    -   Removal of all jewellery including rings, watches, bracelets for the event

    Non-Compliance to any of the terms and outlined details would result in eviction form site of the Group Member and possibly the entire group, without any reimbursement of costs or re-arrangement of activity. Also, possible legal action taken on behalf of the National Parks, Individuals or Quest Adventures Activities Ltd if detrimental to Park rules and QAALtd company operations and management.

    Due to the present Corona virus Pandemic members of the group will be asked a series of questions to partake on the activity these will include statements of health, contact with others and past medical histories. Temperatures may be taken on the day and an overall view of health and well being. Where possible members of the group will have to socially distance and adhere to government legislation for the period of time relevant to the activity.

    The group will be encouraged to assist each other on the event and create minimal contact with the instructor and instructional team. In the case of a respiratory issue, instructors will provide assistance in accordance with covid regulations and policies at the time of the event.

    Each person taking part in any of the activities must complete the medical declaration form completely and honestly, if an issue is highlighted the participant must consult with the instructor outlaying the details of the issue and how this may affect them personally on the activity. After the conversation with the instructor both parties with acknowledge their own responsibility and decide whether they are able to take part in the activity after discussing the issue and the details of the physical and mental ability to take part in the activity. After any discussion the instructor may advise the participant not to take part in the activity or to avoid certain aspects such as jumping, swimming, leaping etc. It would be acknowledged from both parties that if the participant were to take part after full disclosure they would have to agree to the advice of the instructor and take full responsibility if they were to take any actions against and in contradiction to the advice given. Both parties must agree to the decision after the conversation has taken part and in full awareness that to go against the advice given may be detrimental to their safety and the safety of the rest of the group.  All members of the group must have full knowledge of the activity they are partaking in prior to attending the event.

Issue of payment either deposit or in full authorizes full understanding, acknowledgment and acceptance of booking terms, conditions and regulations set out in this confirmation of booking agreement and/or full booking terms and conditions attached.

    Because of the challenging mountainous rugged terrain can you make sure the group understand to wear walking boots, sturdy athletic cushioned soled running trainers ie Karrimor Sabre Trail Running Trainers or similar ( STRICTLY NO flat bottomed trainers, converse, football trainers, skate shoes, daps, wet boots, soft soled footwear, unsuitable damaged footwear etc) to walk in the environment, swimwear(under the wet suit), shorts for over the wet suits and Non-Cotton, base layers which they will wear under their wet suit, a large towel to change under and change of footwear and clothing for after the activity. Also can you let us know the general sizes of the group ie S/M/L/XL/XXL and their names to match so we can prepare the equipment.   6. Photography & Media
    Q.A.A.Ltd may provide photographs and footage of the event attended, by paying the deposit or payment in full all members agree for the footage taken to be shared on social media and/or used by Q.A.A.ltd for promotion and presentation unless otherwise notified that this is not suitable or accepted by the members taking part in the event.

Booking Terms and Conditions

I have had brought to my attention the terms and conditions relating to this booking, in particular, those concerning cancellation and safety.

I understand that bookings are accepted on the understanding that Quest Adventures safety regulations are observed.

I accept that Quest Adventures are not under any liability whatsoever in respect of loss or damage to personal property, not caused by the negligence or default of Quest Adventures, its suppliers, its agents and employees whilst attending the activity.

I have had my attention drawn to the information about insurance cover in paragraph 4.2. I fully accept the booking terms and conditions and willing pay a deposit or full payment for the event with the full acceptance of the terms and conditions relating to myself and/or all other members of my booking.

Infection Protection and Control Policy

All members of the group must be fit and well to take part in the activity. Any members showing signs of illness including coughs, colds, temperature, generally unwell will not be able to take part in the activity or be associated with the rest of the group. All members of the activity must advise if they feel unwell or have been unwell in the last 24 hours including the symptoms of coughs, high temperature, colds etc.

All members must state if they have been in contact with anyone in the last 10 days with coronavirus, have contracted coronavirus, are in isolation from coronavirus, suspect they have coronavirus, have been in contact with track and trace due to contact with coronavirus.

All members must keep a 2 meter distance from staff when briefing and donning equipment, all members must keep at least 1 meter distance from staff members when on the activity, all members must follow the government policies and procedures with regards to I.P.C including washing hands, keeping a relative distance and providing information if they feel unwell or have been in contact with the virus.

If an incident were to occur on the activity staff members may have to take closer contact with a member of the group for the members safety and to organise immediate care and attention to the person. Other group members will still adhere to IPC policies at this point unless there is a situation where the group may be in an immediate risk.

Members of the group must adhere to these policies and also give true and factual information, any member not following the rules and guidelines will mean the expulsion of the whole group from the activity. Members may also be asked to have their temperature taken or asked a series of questions on their health, symptoms, and their contact of any source with the coronavirus.

All members must agree to these IPC policies and undertake the activity fully aware of the policies and the implications of the policies.
